This is the first post in a series of articles which will deal with common questions asked in regards to the issuance of warrants in relation to child support in southern Nevada. I am writing on this issue due to the fact that there is often confusion regarding how warrants are issued and how to deal with them. I am writing this series, therefore, with the goal of providing information which will help people to better understand their situation. It is also my goal to provide information which will assist with the selection of an attorney. If you or a loved one are in need of assistance then contact my office today to speak with a Las Vegas lawyer.
I will be addressing several topics over my coming articles. Issues which I will discuss include the following:
- Dealing with a warrant that has been issued in a child custody case
- Quashing a warrant that was obtained in a child support action
- The question of “can you go to jail for not paying child support?”
- How far behind one must be on support before a warrant will issue
I am addressing these particular topics for several reasons. First, warrants can be issued in an existing child custody case after a non-paying parent has failed to “show cause” as to why they should not be held in contempt. Warrants may also be issued as part of a District Attorney initiated enforcement action. In either of the instances, an attorney may file a request on your behalf to Quash the warrant and to set up payment arrangements. Second, the answer to whether one can go to jail for failing to pay support is “yes.” It must be understood, however, that the Court’s goal is to obtain payment. If delaying incarceration helps to meet that goal then the Court will do so. Finally, how long it takes for a warrant to issue is within the discretion of the Court.
A key point I will be making in each of these articles is that one should speak with an attorney as soon as possible if they are behind on their child support payments. Non-payment can result in jail time, the suspension of driving privileges, wage garnishments, and more. I am a Las Vegas child support lawyer who practices exclusively in the area of family law. I am experienced in the handling of such matters and I look forward to being of assistance. Contact my office online or by telephone today to schedule an initial consultation.
