I feel it is necessary to address these topics for a number of reasons. First, the legal system can move very quickly when a child’s physical or mental well being is in legitimate danger. Second, there are very few situations in which a parent should contact Child Protective Services before calling a lawyer. Doing so may, in fact, result in the reporting parent receiving less time with the child. Finally, while the Court will issue a temporary order at the beginning of a case or the early stage of a request for a change, it is important that parents understand the process of making the order permanent.

It is important that you speak with an attorney as soon as possible if you or a family member are in need of a temporary child custody change. If the situation is urgent, and you wait to file a Motion with the Court, the Judge may have doubts that the matter is truly an emergency.
