This article is being written to conclude and recap my series on the rights of married parents in Las Vegas and other southern Nevada areas. I considered it important to write on this topic due to the fact that divorce and child custody are intertwined and married parents are often unsure as to how they should proceed. Not knowing what to do can result in one staying in a bad situation longer than necessary. I wrote this series, therefore, with the goal of providing information which will help people to better understand their situation. It has also been my goal to provide information which will assist with the selection of a family law attorney. If you are in need of assistance then contact my office today to speak with a lawyer.
I addressed several topics over my recent articles. Issues which I analyzed included the following:
- The fact that mothers and fathers have equal rights in Nevada
- Why separated parents should obtain a Court Order
- Parents should file for divorce if they are in a bad situation
- The process for parents going through a divorce
There are multiple reasons why I chose to address these particular topics. First, many still have the belief that mothers have “more rights” than a father. Nevada, however, is a state which believes that parenting should be shared between mom and dad. The Court will only vary from this presumption of joint custody if doing so would protect the best interest of the child. Second, Nevada’s presumptions can make parenting difficult for separated individuals who lack a custody order. Gaining an Order from the Court, which requires filing for separation or divorce, is an important step. Third, if a parent is in a bad situation then waiting to file for divorce can result in the Court thinking that the current state of affairs is a “status quo” which should be followed. Finally, knowing what to expect from the process is vital to making a decision as to whether or not to move forward.
