This article is being written to conclude and recap my series on whether or not one may be able to obtain a “quick” divorce in Las Vegas and other Nevada areas. I considered it important to write on this topic due to the fact that the nature of our state’s divorce laws are often misunderstood. While it is true that Nevada has what are most likely the most liberal divorce laws in the country, one is not able to instantly end their marriage in our state. The goal of my recent articles was to provide information which will help people to better understand their situation. It has also been my goal to provide information which will assist with the selection of an attorney. I addressed a number of topics over my recent articles. Issues which I analyzed included the following:
- Eligibility to file for Nevada divorce
- How long uncontested divorces often take
- Divorcing your spouse when they cannot be located
- Why contested divorce cases take longer than uncontested matters
There are several reasons why I chose to address these particular topics. First, one may not move to Nevada and simply file for divorce the next day. An individual must have been a resident of our state for at least six weeks to initiate the process. Even then, the Court may lack jurisdiction over key issues. Second, the uncontested process can often be handled within one to two weeks, but the parties must be in agreement on all issues. Third, if a spouse cannot be located then they may be served through a process known as “publication.” This process, however, can add more than a month to the time the case will take. Finally, understanding why disagreement can lead to a lengthier case can help spouses to understand that settlement may be in their best interest.
A key point I made in each of these articles is that one should retain an attorney immediately if they are considering ending a marriage. Retaining counsel sooner, and not later, can help to avoid unnecessary steps or errors which may otherwise delay the case.
