This is the first post in a series of articles which will address ways to prove parental drug use in a Las Vegas, Nevada child custody case. I consider it important to address this topic as it is important for parents to take action if they believe that their child is in danger. It is also important, however, for parents to avoid making unfounded accusations in Court. I am writing this series, therefore, with the goal of providing information which will help people to understand their particular situation. Another goal of this series is to provide information which will assist with the selection of an attorney. If you or a loved one are in need of assistance then contact my office today to speak with a lawyer.
I will be addressing a number of topics over my coming articles. Issues which I will be analyzing include the following:
- When Clark County Family Court Judges will require an immediate drug test
- The need for discovery in a drug-related case
- Filing a change of custody request when a parent has been arrested for a drug-related offense
- The need to avoid making false accusations about the other parent
I have chosen to address these particular topics for a number of reasons. First, Courts will often require an immediate test when a parent makes a credible claim of drug use against their counterpart. Such tests are typically required in situations where the drug use is not obvious. These can include matters where there has been no drug-related arrest, etc. Second, it can be necessary for a parent to show that drug use has been ongoing (especially in matters involving prescription medication abuse). Discovery is the method by which proof of abuse can be obtained. Third, when a parent has been arrested and charged with a crime, then the Court will often entertain an immediate request to change custody. Finally, if false accusations are made against the other parent then the accusing party may actually find their time with the child reduced.
A key point I will be making in each of these articles is that one should contact a family law attorney as soon as possible if they believe their child is in danger. Depending on the situation, it may be possible to gain a hearing before the Judge within a few business days. I am a Las Vegas child custody lawyer with experience in such matters. If you or a loved one are in need of assistance then contact my office today to schedule an initial consultation. We look forward to speaking with you.
