There are multiple reasons why I chose to address these issues. First, a postnuptial agreement is a legal contract, between spouses, which can be enforced at the time of divorce. While it does not stop a spouse from behaving irresponsibly, it does offer protections at the end of a marriage. Second, there may be some instances in which the parties might prefer a legal separation. These include instances where the spouses will no longer be living together and children are involved. Third, for a postnuptial agreement to be enforceable, certain requirements must be met. Also, the parties must not commingle their assets. Fourth, understanding what happens after the signing of an agreement is important to understand your rights. Finally, such a contract can help to shield an individual against their spouse’s tax problems.
