There are multiple reasons why I chose to address these topics. First, parents should be aware that the court does not regard fathers as “dad” until paternity is established. This means that the court will not require the father to pay child support payments until he is determined to be the child’s father. Second, the process for establishing paternity begins by filing a complaint with the court. Once a complaint is filed, the court will order a DNA sample from the father and schedule a return hearing date. Third, cases which establish paternity will also focus on custody, visitation, and child support. This is why paternity cases are exceptionally important and should be handled by professionally trained paternity lawyers. Finally, parents with physical custody of their child should understand that the court will not award more than four years of back child support. This is the case regardless of how long the non-custodial parent has not been paying child support.
