Money on gavelThis is the first post in a series of articles which will discuss the ability of a parent to collect back child support in Las Vegas and other Nevada areas. I feel it is important to write on this topic as the subject of collecting arrearages is something that often causes confusion and tension between parents. The goal of my coming articles is to provide information which will help people to better understand their situation. It is also my goal to provide information which will assist with the selection of a family law attorney.

There are multiple reasons why I am choosing to address these particular topics. First, Nevada law allows a parent to recover child support for the four years prior to the filing of a legal case. Second, this four year limitation can be tolled (meaning it is stayed) by sending a letter to the paying parent’s last known address. Third, filing an action as soon as possible helps to ensure that back support is not lost to the statute of limitations. Fourth, calculating back support will require analyzing the paying party’s income during that time. Finally, understanding the options for collecting the unpaid support is critical.

An important point that I will stress in each of these articles is the need to take immediate action to protect your rights. It is common for parents to not immediately demand support out of a desire to maintain the peace. Each month that one waits to take some form of action, however, is another month of support which cannot be recovered in the future.
