This is the first post which will discuss the handling of emergency child custody cases in Las Vegas, Nevada. I previously discussed several aspects of emergency custody modifications. Due to interest in that discussion, I will be using this series to expand upon it with additional topics. The goal of my coming articles is to provide information which will help people to more fully understand their situation. It is also my goal to provide information which will help people to make an informed decision when they are selecting an attorney. If you or a loved one are in need of assistance then contact my office today to speak with a lawyer.
I will be addressing several topics over my coming articles. The issues which I will analyze include:
- Why parents should go through the legal process and not engage in “self help”
- Emergency situations which involve parental drug use
- Situations which involve drug use by the child
- Cases involving physical or sexual abuse
These are important topics to address. First, many parents make the mistake of taking matters into their own hands when they believe their child is in danger. Unfortunately, this can hurt one’s chances of obtaining a custody modification. Second, how the Court will rule, when one parent is abusing drugs, is always going to depend on the facts of the case. It is crucial, therefore, that you discuss the situation with counsel. Third, when a child is using drugs the Court will be concerned as to the extent to which such behavior is a parenting problem or if the issue stems from another source. Finally, cases involving abuse should be taken to Court immediately.
One point I cannot stress enough is that you should contact an experienced family law attorney immediately if you believe that your son or daughter is in danger. The longer you wait, then the more likely the Court is to believe that the situation is not truly an “emergency.” By taking immediate action, you help to make sure that the best interests of your child are protected.
