There are multiple reasons why I chose to address these topics. First, many parents will try to keep the child in violation of a current custody order when their counterpart has been arrested. While this conduct comes from understandable concern, it is important to understand that the Court will typically frown on “self-help.” Instead, it is important to go through the legal process. Experienced counsel can often obtain a Court hearing, within a few business days, in such situations. Second, the Court is often willing to impose supervised visitation following an arrest. It is important to understand the process of bringing such a request and to know what to expect from such visits. Third, depending on the outcome of the criminal matter, the Court may make a final change of custody without a trial. Finally, if a parent has lost joint custody due to drug use then it is important for them to understand how they might be able to get it back.

An important point which was stressed in each of these articles was the need to contact an attorney as soon as possible if the other parent of your child has been arrested. The Court’s sole concern in any matter will be for the best interests of the child and the Judge will act quickly to preserve those interests.
